These Terms of Service ("Terms") govern your access to and use of KoboToolbox Services’ services related to KoboToolbox, including our subscription-based portal (SaaS) and custom self-hosted deployments (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

By using the Services, you confirm that you are at least the age of majority in your jurisdiction and have the authority to agree to these Terms on behalf of yourself or the organization you represent.

2. Services

We provide access to a hosted KoboToolbox portal (SaaS) and offer custom deployments of KoboToolbox in your infrastructure. Features and availability may vary by plan and deployment.

3. Accounts and Subscriptions

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Subscription details (plan limits, pricing, and billing cycles) are provided during signup or in your agreement.
  • We may change plan features and pricing with reasonable notice for recurring subscriptions.

4. Acceptable Use

  • Do not misuse the Services or attempt to access them using a method other than the interface and instructions we provide.
  • You must comply with applicable laws, including data protection and export control regulations.
  • Prohibited content includes illegal, infringing, or harmful material and activities that could disrupt the Services.

5. Data and Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and safeguard personal data. You are responsible for obtaining all necessary consents from your respondents and users.

6. Your Content

You retain all rights to the content and data you submit to the Services. You grant us a limited, non-exclusive license to host and process your content solely to provide and improve the Services. You represent that you have all necessary rights to submit the content.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your content, your use of the Services, or your violation of these Terms.
